1.  Introduction
This page sets out the terms on which you may make use of our website www.pimfa.co.uk (“our site”) whether as a guest or as a registered member.  By using our site you indicate that you accept these Terms and agree to abide by them.  If you do not agree to these Terms please refrain from using our site.

2.  Information About Us
2.1     www.pimfa.co.uk is operated by the Personal Investment Management & Financial Advice Association (PIMFA), the trade association for financial advisers (“we/our/us”).  We are registered in England and Wales under company number 2991400 and our registered office and trading address is 69 Carter Lane, London EC4V 5EQ.

3.  Other Terms
These Terms are to be read in conjunction with the following additional documents: PIMFA’s Privacy Policy which sets out the terms upon which we process your personal data; PIMFA’s Cookie Policy which explains about cookies on our site; and PIMFA’s Events & Services Terms and Conditions which govern the terms upon which you book events or services from the PIMFA.

4. Accessing Our Site
4.1       Access to our site is permitted on a temporary basis and we reserve the right to withdraw or amend access without notice.  We will not be liable if for any reason our site is unavailable at any time or for any period.

4.2       From time to time we may restrict access to some parts of our site or to the entire site to members only.

4.3       You are responsible for making all arrangements necessary for you to have access to our site.  You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these Terms and that they comply with them.

4.4       We aim to update our site regularly and may change the content at any time.  If the need arises we may suspend access to our site or close it indefinitely.  Any of the material on our site may be out of date at any given time and we are under no obligation to update such material.  We may also revise these Terms at any time.  Some of the provisions contained in these Terms may also be superseded by provisions or notices published elsewhere on our site.

4.5       You may only use our site for lawful purposes.  You may not use it in any way that breaches any applicable local, national or international law or regulation or for any unlawful or fraudulent purpose.

5.  Intellectual Property Rights
5.1       We are the owner or licensee of all intellectual property rights in our site and in the material published on it.  Those works are protected by copyright laws and treaties around the world.  All such rights are reserved.

5.2       You may print off one copy and may download extracts of any pages from our site for reference purposes and you may draw the attention of others within your organisation to material posted on our site.

5.3       You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way and you must not use any illustrations, photographs or any graphics separately from any accompanying text.  Our status (and that of any identified contributors) as the author of material on our site must always be acknowledged.

5.4        Personal Investment Management & Financial Advice Association (PIMFA), is a UK registered trade mark of Personal Investment Management & Financial Advice Association (PIMFA).

6.  Liability
6.1       Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed.  We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site or by anyone who may be informed of any of its content.

6.2       The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy.  To the extent permitted by law we and any third parties connected to us expressly exclude:-

6.2.1     All conditions, warranties and other terms which might otherwise be implied by law;

6.2.2     Any liability for direct, indirect or consequential loss or damage incurred by any user in connection with our site, any websites linked to it and any materials posted on it, including:

(a)       loss of income or revenue;

(b)       loss of business;

(c)       loss of profits or contracts;

(d)       loss of anticipated savings;

(e)       loss of data;

(f)       loss of goodwill, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable provided that this condition shall not prevent claims for loss of or damage to your tangible property.

6.3       This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited by law.

7.  Viruses etc
7.1       You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.  You must not attempt to gain unauthorised access to our site, the server on which it is stored or any server, computer or database connected to our site.  You must not attack our site via a denial or distributed denial of service attack.  We will report any breach of this provision to the relevant law enforcement authorities and we will co-operate with them by disclosing your identity to them.

7.2       We will not be liable for any loss or damage caused by a denial of service attack, virus or other technologically harmful material that may infect your computer equipment, computer programmes, data or other proprietary material due to your use of our site, or to the downloading of any material posted on it or on any website linked to it.

8.  Linking To Or From Our Site
8.1       You may link to our home page provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association,  approval or endorsement on our part where none exists.  You must not establish a link from any website that is not owned by you.

8.2       Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.  We reserve the right to withdraw linking permission without notice.

8.3       Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only.  We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

9.         Jurisdiction and Law
The English Courts will have exclusive jurisdiction over any claim arising from or related to our site or these Terms and any dispute or claim arising out or in connection with them shall be governed by and construed in accordance with English Law.

Additional terms for PIMFA members/registered users

10.      Passwords
You must treat as confidential and not disclose to any third party any user identification code, password or other piece of information used as part of our security procedures.  We have the right to disable any member’s identification code or password, whether chosen by you or allocated by us at any time if in our opinion you have failed to comply with any of the provisions of these Terms.

11.      Uploading Material To Our Site
11.1     Whenever you make use of a feature that allows you to upload material to our site or to make contact with other registered users of our site, you must comply with the Content Standards set out below.  You warrant that any such   contribution complies with these standards and you indemnify us for any breach of this warranty.

11.2     Any material you upload will be considered non-confidential and non-proprietary.  We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our site constitutes a violation of their intellectual property rights or of their right to privacy.

11.3     We will not be responsible or liable to any third party for the content or accuracy of any materials posted by you or any other user of our site.

11.4     We have the right to remove any material or posting you make on our site if in our opinion such material does not comply with these terms.

12.       Content Standards
12.1      Contributions must:

12.1.1    Be accurate (where they state facts);

12.1.2    Be genuinely held (where they state opinions);

12.1.3    Comply with any applicable laws.

12.2       Contributions must not:

12.2.1     Contain any material which is defamatory of any person or is obscene, offensive, hateful or inflammatory;

12.2.2     Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

12.2.3     Infringe any copyrights or trade mark of any person or be made in breach of any legal duty owed to a third party, such as a duty of confidence;

12.2.4     Be likely to deceive any person

12.2.5     Promote any illegal activity; or

12.2.6     Be abusive or invade another’s privacy.

 

1. Definitions
1.1 The “PIMFA”, “we”, and “our” mean the Personal Investment Management &  Financial Advice Association, whose principal place of business is at 5th floor, 69 Carter Lane, London EC4V 5EQ, United Kingdom.

1.2 “You” and “your” refer to the registered PIMFA website user and/or PIMFA event or seminar attendee (“delegate”). Your use of PIMFA’s products, events, seminar courses and websites (collectively referred to herein as the “Services”) is subject to the terms of a legal agreement between you and the PIMFA.

2. Accepting the Terms and Conditions (thereafter “Terms”)
2.1 In order to use our Services, you must firstly agree to the Terms.

2.2 You can accept the Terms by:

•  Clicking to accept or agree to the Terms, where this option is made available to you by the PIMFA in the user interface for the Services; or

•  By actually booking or using our Services. In this case, you understand and agree that we will treat your use of the Services as acceptance of the Terms from that point onwards. If you are registering on behalf of another it is your responsibility to ensure that the delegate is aware of the Terms and accepts them, and by completing the registration, you are warranting that you have made the delegate aware of the Terms and that they have accepted the Terms.

2.3 The Terms will continue to apply until terminated by PIMFA.

3. Use of Services
3.1 In order to access certain Services, you may be required to provide information about yourself (e.g. identification or contact details) as part of the registration process for the Services, or as part of your continued use of the Services.

3.2 You agree that any registration information you give to PIMFA will always be accurate, correct and current.

3.3 Unless you have been specifically permitted to do so in a separate agreement with PIMFA, you agree that you will not: (i) reproduce, duplicate or copy, or (ii) sell, trade, resell or otherwise commercially exploit, any of the Services, or any part thereof, for any purpose.

4. Passwords and Account Security
4.1 You agree and understand that you are responsible for maintaining the confidentiality of passwords associated with any account you use to access our Services. For the avoidance of doubt, you agree that you will not permit any other person to use your account or password to access our services.

4.2 Accordingly, you agree that you will be solely responsible to PIMFA for all activities that occur on your account.

4.3 By accessing our Services, you agree to abide by the terms of PIMFA Legal Notices regarding Intellectual Property, the Privacy Policy and the Acceptable Use Policy.

5. PIMFA Membership
5.1 Registration to our website does not automatically constitute membership to PIMFA, either full or associate. Please refer to our website for details on how to become a full or associate member.

5.2 Membership of PIMFA is governed by the Membership Rules.

Events Terms & Conditions

1. General

1.1 The Events terms and conditions should be read in conjunction with the PIMFA General terms and conditions.

1.2 The “PIMFA”, “we”, and “our” mean the Personal Investment Management & Financial Advice Association, whose principal place of business is at 5th floor, 69 Carter Lane, London EC4V 5EQ.

1.3 “You” and “your” refer to the registered PIMFA website user and/or PIMFA event attendee (“delegate”). Your use of PIMFA’s products, events and websites (collectively referred to herein as the “Services”) is subject to the terms of a legal agreement between you and the PIMFA.

2. PIMFA membership

2.1 Registration to our website does not automatically constitute membership to the PIMFA, either full or associate. Please refer to our website for details on how to become a full or associate member.

3. Payment for PIMFA events

3.1 Upon acceptance to the event, you will receive confirmation and a dated invoice.

3.2 We request full payment within 30 days of the date of the invoice or prior to the event taking place, whichever occurs sooner.

3.3 All events are subject to VAT at the prevailing rate.

4. Cancellations, substitutions and non-attendance by the delegate

4.1 If you are unable to attend an event, you may nominate a suitable substitute delegate from the same company to attend in your place. There will be no additional charge provided that you inform the PIMFA of the substitution prior to the event taking place.

4.2 There is no charge for transferring your booking to another event in the same series on an alternative date, provided that you notify the PIMFA in writing up to 30 days before the start of the event you are booked on, and provided that the alternative event takes place within 12 months of the original event. If there is a discrepancy between the costs of events, the delegate will be required to pay the difference plus VAT to the PIMFA.

4.3 If you are unable to attend and are unable to transfer your place (in line with 6.1 or 6.2 above), provided that you notify the PIMFA in writing or via email up to 30 days before the start date of the event, you will receive a full refund.

4.4 If you fail to notify us of a transfer of booking (in line with 6.1 or 6.2 above) or withdraw for whatever reason, within 30 days of the event, the full fee will be non-refundable and remain payable in full.

5. Warranties and limitation of liability

5.1 Joining instructions for events will include an outline of the day, venue details, map and local hotel details, if applicable, and shall be issued approximately two weeks prior to the event. It is the responsibility of the delegate to contact the PIMFA if joining instructions have not been received. The PIMFA will not be held responsible for nonreceipt of joining instructions and refunds will not be issued under such circumstances.

5.2 The PIMFA gives no warranties in respect of any aspect of the event or any materials related thereto or offered at the event and, to the fullest extent possible under the laws governing the Agreement, disclaims all implied warranties, including but not limited to warranties of fitness for a particular purpose, accuracy, timeliness and merchantability. Neither the PIMFA nor its affiliates can accept any responsibility or liability for reliance by you or any person on any aspect of the event or any information provided at the event.

5.3 None of the materials pertaining to our events are intended to constitute financial, legal or other advice, should not be relied upon as such and is not a substitute for obtaining such advice. The PIMFA, its employees, trainers, contractors or consultants do not accept responsibility for delegates’ actions, or those of any other people reading event notes or interpreting the event in litigation.

5.4 The PIMFA does not accept responsibility for complaints arising from possible food poisoning or allergies and all such complaints should be addressed or directed to our catering companies, which can be contacted through us upon request. We will take reasonable steps to communicate any special requests/dietary requirements on behalf of the delegate if they are provided at the time of booking.

5.5 While the PIMFA endeavors to ensure reasonable safety and security at our events, it must be understood that all parties attending do so at their own risk. We will not be held responsible for injuries that may be incurred as a result of attending an event where the circumstances are outside of our control. Neither the PIMFA nor its affiliates shall be liable for any direct, indirect, special, incidental, or consequential costs, damages or losses arising directly or indirectly from the event or other aspect related thereto or in connection with the Terms. However, nothing in these terms and conditions or any other terms of the PIMFA seeks to exclude liability for death or personal injury resulting from the PIMFA’s negligence.

6. Changes and cancellations by the PIMFA

6.1 You acknowledge and agree that we reserve the right to change any and all aspects of the event including but not limited to, the event name, themes, content, programme, speakers, hosts, moderators, venue and time.

6.2 We also reserve the right to cancel an event at any time without liability. In these circumstances, we will offer an alternative date, a credit note or a full refund, but no compensation will be paid for any additional costs incurred.

7. Concessions

7.1 A concession or discount offered on PIMFA events is exclusive; concessions or discounts cannot be combined.

7.2 Except for company-wide or pre-agreed discounts, the higher discount will always be applied.

7.3 In the case of special offers, these must be requested at the time of booking in accordance with the relevant offer terms and conditions; they will be applied automatically.

8. Late payment

8.1 Late payment is defined as not having paid within 30 days of the date that appears on the invoice or after the event has occurred.

8.2 In the case of late payment, we reserve the right to charge interest on all outstanding payments at the rate of 2 per cent per calendar month, or part thereof if less than a calendar month, until payment is made.

8.3 In any case where the delegate has not paid, or for example has other outstanding payments, we reserve the right to refuse entry to our events.

9. Media

9.1 By attending a PIMFA event, you acknowledge and agree to grant the PIMFA the right at the event to record, film, photograph or capture your likeness in any media now available and hereafter developed and to distribute, broadcast, use or otherwise globally to disseminate, in perpetuity, such media without any further approval from you or any payment to you. This grant to the PIMFA includes, but is not limited to, the right to edit such media, the right to use the media alone or together with other information, and the right to allow others to use and/or disseminate the media.

Equality, diversity and inclusion statement

10. Code of conduct

10.1 All participants of PIMFA events and learning – inclusive of, but not limited to, all attendees, speakers, exhibitors, sponsors and volunteers – are required to agree with our code of conduct.

11. Speaker representation

11.1 PIMFA is a proponent of diversity, inclusion and equity and as such we will make best endeavours to research and select speakers that are representative of varying backgrounds, experience and other diverse characteristics.

12. Inclusive spaces 

12.1 Attendees are asked before every event if they have any accessibility requirements they wish to disclose to ensure venues are suitable to welcome an audience with mobility, visual or hearing requirements, and from any religious affiliation. We are committed to using venues that provide:

  • Wheelchair access to the building and accessible toilet
  • Hearing loop.
  • Quiet space/prayer room.
  • Catering inclusive of all dietary requirements.
  • Accessible materials
  • Any other specific requirement highlighted to the PIMFA team by an event participant

13. Content and presenters

13.1 We want our speakers and chairs to be mindful of their audience and be inclusive with their delivery and content. All participants in PIMFA events are briefed in accordance to the Equality and Human Rights Commission event planning guide to engaging with disabled people.

14. Sponsor and partner contributions

14.1 We align with organisations that champion diversity and look to them to support us in delivering event programmes that are representative of our communities and our members. We will look favourably on sponsors and partners who reflect this by fielding a diverse and inclusive set of speakers to participate in an event.
